4-Year-Old Can Be Sued, Judge Rules in Bike Case

Citing cases dating back as far as 1928, a judge has ruled that a young girl accused of running down an elderly woman while racing a bicycle with training wheels on a Manhattan sidewalk two years ago can be sued for negligence.

The ruling by the judge, Justice Paul Wooten of State Supreme Court in Manhattan, did not find that the girl was liable, but merely permitted a lawsuit brought against her, another boy and their parents to move forward.
The suit that Justice Wooten allowed to proceed claims that in April 2009, Juliet Breitman and Jacob Kohn, who were both 4, were racing their bicycles, under the supervision of their mothers, Dana Breitman and Rachel Kohn, on the sidewalk of a building on East 52nd Street. At some point in the race, they struck an 87-year-old woman named Claire Menagh, who was walking in front of the building and, according to the complaint, was “seriously and severely injured,” suffering a hip fracture that required surgery. She died three months later of unrelated causes.
.So a judge, supposedly of sound mind, says a FOUR YEAR OLD, who will obviously have NO means to pay, can be SUED in a court of law.

The concept is both ridiculous and preposterous. And I'm wondering what kind of country would allow such things to occur.

Hey, it's not like this is the real world. It's Manhattan, meaning logic, reality, and common sense don't apply. Besides, they can afford whatever the damage might be.

I've been up there, and I get that. But how is it that such judges don't join Judge Crater?
The true question is, would the old lady have died anyway? What was her cause of death? Did it have anything to do with the accident?
In our "real" world, nobody is ever to blame for whatever happens to them and natural death is a myth. Everything is somebody else's fault. Since there is no real precedent to sue the parents, it has to be the 4 year old.
Stevie, in NYC, such judges are promoted to higher courts where they can do more damage. It's SOP here. As for judge Carter, if he has $50K, he can sit on a NY court also. (being alive is optional)

The old lady is dead, so I'm assuming the spoiled liberal NY 'heirs' are suing. Kick the shit out of them too.
Oh, and let's kick the shit out of the judge and lawyers as long as we're kicking worthless butts.
