AZ law torn to shreds

Federal Judge Blocks Portions of Arizona Illegal Immigration Law

A federal judge on Wednesday blocked some of the toughest provisions in the Arizona illegal immigration law, putting on hold the state's attempt to have local police enforce federal immigration policy.

Though the rest of the law is still set to go into effect Thursday, the partial injunction on SB 1070 means Arizona, for the time being, will not be able to require police officers to determine the immigration status of anyone they stop or arrest.

U.S. District Judge Susan Bolton also struck down the section of law that makes it a crime not to carry immigration registration papers and the provision that makes it a crime for an illegal immigrant to seek or perform work.

In all, Bolton struck down four sections of the law, the ones that opponents called the most controversial. Bolton said she was putting those sections on hold until the courts resolve the issues.

The ruling said the Obama administration, which sought the injunction, is likely to "succeed on the merits" in showing the above provisions are preempted by federal law.

"The court by no means disregards Arizona's interests in controlling illegal immigration and addressing the concurrent problems with crime including the trafficking of humans, drugs, guns, and money," the ruling said. "Even though Arizona's interests may be consistent with those of the federal government, it is not in the public interest for Arizona to enforce preempted laws."

A number of provisions will still go into effect as the case is litigated. Arizona will be able to block state officials from so-called "sanctuary city" policies limiting enforcement of federal law; require that state officials work with federal officials on illegal immigration; allow civil suits over sanctuary cities; and make it a crime to pick up day laborers.

The ruling came just as police were making last-minute preparations to begin enforcement of the law and protesters were planning large demonstrations to speak out against the measure. At least one group planned to block access to federal offices, daring officers to ask them about their immigration status.

This bink used flawed judgement and cited law that was not even applicaple to the AZ law, this was a clinton appointee and campaigned for Obama. I am off to get more ammo, all is almost lost.

The AZ Governor said today that this decision was not a surprise coming from "this judge", which is why the appeal is already in the works. Problem is, that appeal goes to the 9th Circus in Mexifornia, so don't get your hopes up just yet. But since this case will definitely end up in the SCOTUS, there's still hope. It will be up to the Supremes to decide if American citizens have as many rights as illegal aliens have, and if a sovereign state has the right to protect it's borders and it's citizens. If it's decided against the citizens and AZ, we may just get to see that movie Red Dawn become a reality.

My thoughts: Many people have asked why this Marxist govt would actually file suit against AZ, especially since the AZ law mirrors the federal law. IMO, the Marxist-in-Chief had his AG "get the right judge" to issue an order which is guaranteed to make the case go to the SCOTUS. (playing for time) It's also a very safe bet that the case will never get up there in time for the mid-term elections, thereby giving the Demoncrats the benefit. And, if the case is still not settled by 2012, then it's Chairman Obummer who gets the votes from the left and the pro-illegals. Remember, the WH doesn't really care what AZ does. What they do care about is hanging onto the power.

Why would AZ even honor the ruling? Federal courts do NOT usurp state autonomy. AZ has every right to ignore the ruling. Its asinine to think that a branch of the federal government is unbiased in deciding disputes between state governments and federal government.

Missy makes a good point, but not being an attorney, i'm not sure it's valid. If it were that simple, why is AZ taking it to the 9th Circus instead of simply enforcing it's new law as written?

As i said above, i smell a rat here. A Marxist, WH rat. IMO, the actions we're seeing from the AG are not only a diversion, but a clear attempt to grab the pro-illegal votes. By the time this goes to the SCOTUS, the elections will be over and the WH will have created the impression that it has earned the so-called "hispanic vote", even though by most polls, hispanics in this country legally favor the AZ law.
